General Rental Conditions – full version
Art. 1. Purpose
The seasonal rental agreement is established between a tenant and the owner of the residence. In accordance with the Tourism Code (Art. L324-2), the description and price of the rental are communicated to the tenant. Only the information published on the website (except for online pricing errors) and the reservation form issued by the owner will be considered valid. Information disseminated on other sites and networks, as well as photographs, are for illustrative purposes only. These General Rental Conditions (referred to as GRC) apply to all rentals, regardless of the booking method.
Art. 2. Tenant
The person entering into the contract is considered the "tenant". The tenant is required to provide their full contact details, as well as the names of the accompanying persons for whom they are de facto responsible. The owner undertakes not to disclose to any third party the information provided by the tenant in connection with this contract, with the exception of requests for information made by administrations and/or courts.
Art. 3. Contract Conclusion
La réservation devient effective dès lors que le locataire a réglé la totalité du montant du séjour après avoir reçu les informations et l'invitation à payer. Un règlement vaut donc contrat et acceptation sans réserve des CGL ainsi que du règlement d'ordre intérieur qui lui est complémentaire (accessible sur le site internet). En l'absence de paiement (sauf mention particulière dans le contrat), le bien reste considéré disponible et le locataire ne peut se prévaloir de la location qui pourra donc être annulée et bénéficier à un tiers. En tous les cas, et par fairplay, le locataire est tenu d'informer immédiatement le propriétaire s'il souhaite ne pas donner suite ou annuler sa demande de réservation ; en cas contraire, le propriétaire est en droit de refuser le locataire pour une demande de séjour ultérieur.
Art. 3.1. Contract Duration and Arrival/Departure Times
Le locataire conclut un contrat pour une durée déterminée ; il ne pourra en aucun cas se prévaloir d'un quelconque droit au maintien dans les lieux à l'issue de l'expiration de la période de location initialement prévue par le contrat, sauf accord écrit du propriétaire et règlement anticipé du montant de prolongation autorisée. Le locataire est attendu le premier jour de son séjour entre 16H00 et 18H00/19H00 (selon les saisons) et libère la résidence le dernier jour de son séjour au plus tard à 11H00. Tout retard pour le départ peut faire l'objet d'un supplément jusqu'à une nuit supplémentaire, sauf accord pris.
Art. 4. Use of the Premises
The owner will provide premises or a residence that conforms to the description, is clean, with all provided equipment in perfect working order. No work of a non-urgent nature will be undertaken, except for necessary seasonal maintenance of the surroundings.
Art. 4.1.
The tenant shall enjoy the property peacefully and use it properly, in accordance with its intended purpose. It is strictly forbidden to smoke inside the premises.
Art. 4.2.
The erection of tents or the parking of caravans, motorhomes, or cars on the rented property's land is prohibited.
Art. 4.3.
Upon departure, the tenant undertakes to leave the residence and its surroundings in a proper state of cleanliness (dishes washed and put away, barbecue cleaned, parasol folded, pet waste removed, rubbish sorted and disposed of in appropriate containers, etc.). All equipment listed in the inventory must be returned complete and in its original place upon entry. Any replacement, cleaning, tidying, or repairs, regardless of importance, made necessary by the tenant's negligence, will be at their expense.
Art. 5. Payment Terms
All payments are made online upon receipt of the contract. Within a maximum of 24 hours, the stay may be offered to a third party. In all cases, full payment must be made before entry to the premises and does not entitle the tenant to any refund from the owner (see refunds via insurance).
Art. 5.1. Payment Methods
Payment is made via the online payment platform (by credit card), or by bank transfer (tenant's name, residence name, and stay date must be mentioned in the subject line).
Art. 5.2.
Les chèques vacances ANCV (ANCV-Connect) sont acceptés pour les séjours individuels (pas pour les séjours de groupes) ; ils doivent être envoyés par courrier postal recommandé avec accusé de réception, et bien mentionner le bénéficiaire « LBC ». À moins de 5 jours du séjour, les chèques ANCV et le paiement en espèces sont acceptés à l'arrivée sous condition du dépôt d'une caution en ligne au moins égale au prix de la caution et du séjour.
Art. 5.3.
PayPal allows the tenant to pay for their stay in three or four installments. Fees may be owed to the banking institution for this credit. This payment method must be arranged at the time of booking.
Art. 6. Rates
Prices include VAT, mandatory services (linen and cleaning), and all charges (water, electricity, pellets, wood, internet) within the limit of normal use (8 kW/day/person and no exceeding the internet package).
Art. 6.1. Energy Consumption
The tenant is required to ensure that energy is not wasted (heating reduced and lights off in their absence, windows and shutters closed in cold weather, etc.). For long stays, meter readings are taken at the beginning and end of the stay, and the actual consumption amount is settled upon departure. The price announced at the time of booking is firm and final and cannot be modified, neither upwards nor downwards, regardless of changes in the rate schedule (except in case of postponement where the higher rate will be applied).
Art. 6.2.
The amount of the tourist tax (fully remitted to the Communauté des Communes de Saulieu) is regulatory and subject to modification by the administration. It applies to all adults (+18 years old) and is calculated per night. It is paid at the time of reservation, upon arrival, or at the latest on the day of departure. For ease of management and transparency, it is offered for payment during the reservation process. The owner cannot under any circumstances be held responsible for the amount of taxes levied by OTAs (Airbnb, Abritel, etc.) and will not issue any refunds in case of a difference from the effective regulatory rate.
Art. 6.3.
Des avantages ou ristournes peuvent être accordés à discrétion de l'hôte ; ils ne sont en principe pas cumulables. La ristourne la plus avantageuse s'applique. Elles doivent avoir été notifiées lors de l'édition du contrat et ne sont pas remboursables ultérieurement.
Art. 6.4.
Additional fees may be requested for any supplementary administrative work outside of contract management (e.g., requested additional services, multiple payments or/and invoices for group bookings, unvalidated quotes and dossiers, options taken after stay validation, reimbursement dossiers for holiday funds or works councils, etc.).
Art. 6.5.
For long stays (14 days or more), an intermediate cleaning and linen change is scheduled and charged to the tenant. The tenant cannot refuse the weekly visit by management. Management will ensure that the residence is kept in good condition, failing which the stay may be shortened or the security deposit immediately preempted.
Art. 7. Stay Participants
This contract is established for a specific accommodation with a certain capacity.
Art. 7.1.
The number of participants cannot exceed the maximum occupancy capacity indicated in the residence's descriptive statement. Exceptionally, if this rule is deviated from with the written agreement of the owner or their agent, the latter is entitled to increase the price or move the tenant to another chalet with a surcharge.
Art. 7.2.
Le locataire fournit préalablement au séjour la liste des participants (nom, mail et téléphone) et informe le propriétaire de toute visite. La location ne pourra en aucun cas bénéficier à des tiers (personnes non inscrites au contrat) et donc la sous-location est strictement interdite, même à titre gratuit, sous peine de résiliation du contrat voire d'expulsion ; le montant intégral du loyer et de la caution restent acquis ou dus au propriétaire en cas de surcapacité ou de sous-location abusive. Les locataires utilisant les plateformes des OTA sont également tenus de fournir les informations d'identité complètes. Seules les personnes identifiées pourront être bénéficiaires de l'assistance-annulation.
Art. 7.3. Pets
Les chiens et chats sont acceptés dans certaines résidences et en nombre limité (1 maximum par chalet, 2 pour les grands chalets). Les chiens de catégories 1 et 2, les rongeurs, les animaux nuisibles et les NAC sont interdits. Des frais de séjour sont dus pour tout séjour d'un animal. Une caution supplémentaire peut être demandée. Le locataire a bien noté qu'il est strictement interdit de laisser un animal seul dans la résidence en son absence, sous peine d'expulsion immédiate et de rétention complète de la caution ; les chiens et chats sont tenus en laisse sur le parc Badamy et tout excrément est ramassé par son maître.
Art. 8. Security Deposit
Tout locataire (également via les OTA) dépose une caution bancaire numérique au plus tard le jour de son arrivée et avant son entrée dans la résidence, via le système sécurisé Swikly (le montant n'est ni bloqué ni prélevé de votre compte bancaire) ; le locataire garantit ainsi le règlement des frais au cas où un dégât surviendrait dans la résidence ou au matériel loué. Le locataire peut aussi opter pour un dépôt à l'arrivée uniquement durant les heures d'ouverture de la réception, via « TPE » par pré-autorisation bancaire (montant bloqué non débité). Les chèques ne sont pas acceptés.
Le code d'accès et/ou la clé du chalet n'est remis qu'après autorisation de caution. Le montant est libéré après état des lieux et ménage final or en tous les cas n'est pas préempté. Le locataire n'est plus tenu responsable dès le constat d'entrée du locataire suivant. En cas de dépôt d'un chèque, celui-ci pourra être annulé jusqu'à un mois après le séjour (aucun chèque n'est rendu en fin de séjour) et détruit (non renvoyé par courrier postal). En cas de problème constaté (éventuellement en présence d'un huissier ou assureur), la caution est d'abord perçue dans sa totalité ; elle pourra ensuite être en partie ou totalement remboursée selon la situation et le montant des frais. Au cas où la garantie serait insuffisante pour couvrir les frais, le locataire s'engage à compléter la somme due. Le montant des retenues sera justifié par le propriétaire (constat, devis, note de frais, factures …) qui transmettra les documents utiles éventuellement demandés par l'assureur du locataire.
The security deposit is intended to cover any problems occurring during the stay, except those beyond the tenant's control. It also covers any rentals and purchases of equipment and products at Parc Badamy. Tenants who have contracted with an OTA are also liable for a guarantee, which may be held until any damages are settled by the OTA.
Art. 9. Inventory and Check-in/Check-out
The check-in/check-out inventory of furniture and various equipment is carried out at the beginning and end of the stay (during the final cleaning) by the owner or their agent. The tenant accepts that this inventory is performed by them. Upon arrival, the traveler has until 12 PM the following day to perform the check-in inventory, verify the inventory (document available in their online client area), and report any observed anomalies (by email, SMS). After this period, the rented property will be considered perfectly clean, equipped, and free of damage upon the tenant's entry. During the stay or at the latest upon departure, the traveler must report any problems, damage, or breakage. The owner will intervene as quickly as possible once a problem is reported. In case of observed damage, the tenant will be contacted and informed within eight days.
Art. 10. Stay Modification and Cancellation Conditions
Modifications can be taken into account up to 1 month before the stay. Any reimbursements are made by the insurance (under its contractual conditions and provided that the contract was taken out at the time of booking).
Art. 10.1. Stay Postponement
Modification possible des dates du séjour jusqu'à 1 mois avant le séjour. Le report est à faire dans les 12 mois à partir de la date d'annulation et aux conditions de location du moment du nouveau séjour (les CGL éventuellement adaptées s'appliquent à ce contrat reporté), dans un chalet au choix du locataire selon les disponibilités de la nouvelle date ; le propriétaire n'étant pas tenu de mettre à disposition le même chalet. Le tarif du moment de la nouvelle réservation sera appliqué (sans aucun remboursement au cas où la date de séjour choisie serait moins chère, la différence étant imputée en frais de dossier). En cas d'un second report, des frais administratifs pourront s'appliquer.
Art. 10.2.
Change of residence possible up to the day before the stay, subject to availability. The rate of the new chalet applies (with no refund if the chosen chalet is cheaper, the difference being charged as administrative fees). In case of a second change, administrative fees may apply.
Art. 10.3. Stay Cancellation
Any reservation cancellation must be made by email or registered postal mail with acknowledgment of receipt, the date of receipt being proof. Apart from the conditions mentioned elsewhere in this document, no refund or postponement will be made, nor in the following cases: delayed arrival, no-show, and early departure for any reason whatsoever, reduction in the number of participants, circumstances beyond the owner's control (weather, breakdown, riot, epidemic, pandemic, war, attack, etc.).
Art. 10.3.a. Cancellation by the Tenant
The payment remains acquired by the host but may be reimbursed by the insurance within the framework of its conditions. The manager of Parc Chabadamy will provide the necessary documents, either to the tenant if it concerns their insurance, or directly to "Campez couvert" if the insurance was taken out or offered upon booking the stay.
Art. 10.3.b. Cancellation by the Owner
In the event of cancellation by the owner before or during the contract, the tenant is guaranteed a proposal for one or more accommodations of equivalent or superior quality, otherwise a refund of all sums paid or a pro-rata refund for a commenced stay. The owner cannot be held responsible for a lack of accommodation availability. In case of impossible replacement, compensation may be granted to the tenant in the form of a discount on a future stay.
Art. 10.4.
Si le locataire ne se manifeste pas dans les 24 heures qui suivent la date d'arrivée indiquée sur la réservation, son séjour est annulé et le propriétaire peut disposer de sa location à sa guise ; la totalité du séjour et frais liés restent acquis et sont dus au propriétaire.
Art. 10.5.
Cancellation circumstances not covered by insurance will under no circumstances be the responsibility of the owner.
Art. 11. Insurance
Art. 11.1. Rental Insurance
The tenant is required to insure the rented property. They must check if their main home insurance contract includes a holiday extension (vacation rental). Otherwise, they must contact their insurance company to request an extension of the guarantee or take out a special contract, under a "villégiature" clause. An insurance certificate must be provided at the latest on the day of arrival. Failing to present a certificate, the tenant declares on their honor the existence of insurance coverage and, in any case, will be personally held responsible and prosecuted for any damage caused by them, by the persons, and by pets occupying the property under their responsibility. The presentation of an insurance certificate is mandatory for renting the hall.
Art. 11.2. Assistance, Cancellation, and Refund Insurance
The tenant is invited to take out adequate insurance to cover their individual risks. The "Campez couvert" insurance offered by the owner at the time of booking is 5% of the stay and concerns only the rental portion (excluding uninsured services). It covers modification or cancellation fees for many situations (serious illness, complications, accident, death of a relative, official summons, date postponement, late arrival, interruption of stay, replacement vehicle, repatriation including in case of epidemic or pandemic, cancellation fees in case of COVID illness, contact case, quarantine, etc.) according to the updated conditions of the insurer GritchenAffinity.
NB: tenants who paid by credit card can appeal to their travel insurance with their bank, which may cover part or all of these same risks.
Art. 12. Image Rights
Photographs or videos may be taken during a stay. The publication of these images is strictly limited to media aimed at promoting Parc Chabadamy. By entering into this contract, the tenant accepts the use of their image and that of the persons participating in their stay and under their responsibility. Should they not wish their image to be used, they must inform us at the latest on the day of their arrival (by a written note at reception or by email to management, who will confirm receipt of the expressed request).
Art. 13. Disputes
Generally, any complaint must be sent as soon as possible by email to chabadamy@gmail.com, who will intervene to facilitate an amicable settlement of the dispute. For disputes arising from the non-performance of this contract, only the Courts within the department of the residence are competent.

Residential Park Internal Regulations
Art. 1. General Principle
You are in a private, high-quality, quiet, and family-friendly residential area, a natural environment that must be preserved.
Anyone who refuses to respect this spirit and contravenes these regulations, by any act whatsoever (noise, pollution, etc.), will be asked to leave the premises immediately and will be liable for all costs and fines related to their nuisance, or even be expelled from the domain with immediate termination of their contract in the most serious cases. The general interest and the quality of the place determine these rules for communal living.
These regulations apply to everyone: guests, owners, workers, visitors!
Art. 2. Occupancy & Use
Access and Keys
The domain is strictly reserved for residents. All residents and visitors must check in at reception. It is strictly forbidden to entrust keys or access codes to any third party. Similarly, it is forbidden to allow anyone claiming access without being known to the domain to enter.
Plot/Accommodation
Each occupant freely enjoys their accommodation and their plot of land. However, they may not in any way compromise the safety, tranquility, or quality of life of the neighborhood, nor undermine the purpose and coherence of the site. The number of occupants in a residence may not exceed the authorized capacity. Sleeping in a garden shed, vehicle, or tent, caravan, or mobile home is strictly prohibited.
The domain is private property, and each residence within it is also private. Access to the domain is therefore prohibited for non-resident public, just as access to a private residence is not permitted without the express consent of the owner.
It is not permitted to enter a residence, a private garden, or to use or borrow any equipment or amenities found there (parasol, barbecue, tarpaulins, etc.). Similarly, one should not use for oneself any deposited material that does not belong to them (tractor, ladder, etc.).
Terraces and areas surrounding the residence must remain perfectly clean and tidy. Clotheslines are not permitted. A clothes dryer is provided in most chalets and must be removed when not in use. Please inquire at reception for laundry services.
It is not permitted to add new electrical equipment or to install anything without prior agreement.
Circulation within the domain – Unloading/Loading luggage
Traffic is primarily reserved for pedestrians and bicycles; vehicle traffic is limited. To ensure safety, the speed limit is 10 km/hour (drive at a walking pace). Everyone is required to strictly comply with traffic signs/the direction of traffic according to their residence (the shortest path being preferred to limit nuisances), during entry and exit hours, i.e., between 4 PM - 7 PM and 8 AM - 10 AM (12 PM for one-night stays), leaving their vehicle on the path next to the chalet (parking in gardens is prohibited).
Any incident will be the sole responsibility of the driver.
Parking: dedicated space
Each residence has a dedicated parking space assigned by the management: please inquire at reception for your spot.
It is forbidden to park on lawns (a residence's garden), in front of a resident's terrace, at a neighbor's, or in a space not dedicated to your residence.
Un seul véhicule est autorisé par hébergement (même si le résident dispose de plusieurs véhicules) — 2 véhicules pour les 3 grands duplex — ; les autres véhicules devront être garés en dehors du Domaine.
Trucks, vans, trailers, quads, 4x4s, caravans, motorhomes, and tents are not permitted (excluding artisans working for the domain).
Motorbikes and classic cars: please inquire at reception.
Electric cars: we do not yet have a charging station in the residential park. Owners of electric vehicles are required to use the dedicated charging stations in Avallon, Sauvigny-en-Terre-Plaine, Semur-en-Auxois, Saulieu, or Quarré-les-Tombes. Charging at the chalets is strictly prohibited.
Any infraction will cost the vehicle owner 75 € (immediate deduction from the security deposit).
Playground
Playgrounds are exclusively accessible to residents and are used under their full responsibility. They should only be used by children of an appropriate age for the games offered. Children must be accompanied by responsible adults.
Art. 3. Rules of Conduct
Dress Code
Everyone will ensure that their visitors and themselves are dressed appropriately. Nudism is forbidden throughout the domain, including in private gardens.
Noise Disturbances
Residents must ensure the tranquility of all. All noise, of whatever nature, disturbing the peace of the neighborhood, is forbidden (daytime noise) and strictly forbidden between 10:30 PM and 7:30 AM (nighttime noise). Parties such as 'bachelor/bachelorette parties' within the chalets are forbidden for the peace and quiet of all.
If an occasional family celebration causes unusual noise, the resident will inform the manager in advance, and a notice will be displayed as a courtesy to all.
The use of any device emitting significant and/or repetitive noise likely to disturb the neighborhood (quad, mole repellent, etc.) is prohibited, with the exception of technical maintenance equipment and by special, temporary derogation.
Work (maintenance or landscaping) is permitted between 10 AM and 12 PM and between 4 PM and 6 PM to respect everyone's rest. A derogation may be granted in the low season for annual construction and work.
Fires and Barbecues
Fires are strictly prohibited in the Morvan Regional Natural Park and also within the domain, except with special authorization. Mobile barbecues of all types (gas, charcoal, etc.) are prohibited. Electric planchas are available at reception.
Smoking is prohibited inside rented buildings. Discarding cigarette butts will be considered both a cleanliness infringement and a fire hazard.
Any cleaning will be charged, and any damage (personal injury or material) and costs incurred by a fire will be the responsibility and expense of the person who started it. During periods of drought, prohibition instructions may be issued.
A fire alarm is installed in each accommodation, as well as a fire extinguisher.
Waste
Waste sorting is mandatory, according to local and displayed instructions. No dumping of any kind, including natural waste, will be tolerated on the property. Everyone is asked to dispose of their waste within 24 hours, particularly at the waste disposal center (La Roche-en-Brenil). Illegal dumping (also next to containers) will be subject to a severe penalty.
Pets
Dogs and cats are allowed in certain residences, and under your full responsibility. They must be declared, kept on a leash, and their droppings must be picked up immediately. Roaming by dogs and cats is prohibited. It is also forbidden to leave dogs alone in a chalet. New pets (NAC) and rodents are strictly prohibited.
Weapons and Narcotics
The possession of Category D weapons (knife, bow, air pistol, etc.) and firearms of any category is strictly prohibited. The possession of narcotics, drugs, and hallucinogens is prohibited. Drunkenness in the common areas of the domain is forbidden.
Art. 4. Complaints & Penalties
All complaints relating to inconveniences of any kind, various observations, and suggestions should be made by email to chabadamy@gmail.com, or on plain paper attested and signed by the declarer and submitted at reception.
They must be nominative and include contact details (name, plot, telephone number). The description of the problem must be precise and the inconvenience dated. Issues will be resolved as quickly as possible.
In case of non-compliance with these regulations, the resident will be asked to modify their behavior. In the event of serious misconduct, the tenant's stay may not be renewed, or even shortened. They will be responsible for costs related to restoration and/or liable for a fine of an amount determined by the manager according to the severity.
